SUI GENERIS INC, doing business as Sui Generis Designer Consignment ("Sui Generis," "we," "us," or "our"), is an independent designer resale and consignment retailer based in California. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit suigenerisconsignment.com, shop with us online or in our store, create an account, join our mailing list, contact us, consign merchandise, or otherwise interact with us.
This Policy applies to our online and offline business activities. It does not apply to information processed solely on behalf of another business or to third-party websites and services that maintain their own privacy policies.
1. Personal Information We Collect
Depending on how you interact with us, we may collect the following categories of personal information:
• Identifiers and contact information, such as your name, email address, telephone number, billing and shipping address, account username, IP address, and similar identifiers.
• Customer-record information, such as payment and transaction details, signatures, communications, and information used to provide customer service. Payment-card information is generally processed by Shopify and payment providers rather than stored directly by Sui Generis.
• Commercial information, such as products viewed, saved, purchased, returned, consigned, or considered; order history; shipping and delivery information; preferences; and participation in promotions or loyalty features.
• Internet and electronic activity, such as browser and device information, cookie and pixel identifiers, referring pages, pages viewed, searches, clicks, interactions with emails or advertisements, and approximate location inferred from an IP address.
• Audio, visual, and similar information, such as product or provenance photographs you submit, customer-service recordings where permitted, and security-camera footage in our physical store.
• Consignor and supplier information, such as contact details, item ownership and provenance information, payout instructions, transaction history, and tax or identity information when required for payment, fraud prevention, or legal compliance.
• Inferences, such as likely product interests or shopping preferences derived from your interactions with our store.
• Sensitive personal information, when reasonably necessary, such as account credentials, payment information handled by payment providers, government identification used for verification, and tax or financial-account information used for consignor payouts or legal reporting. We do not use sensitive personal information to infer characteristics about you.
You may choose not to provide certain information, but doing so may prevent us from completing a purchase, shipment, consignment, payout, account request, or other service.
2. Sources of Personal Information
We collect personal information from:
• you, including through checkout, customer accounts, forms, email, telephone, in-store interactions, consignment documents, and customer-service communications;
• your device or browser through cookies, pixels, local storage, logs, and similar technologies;
• Shopify and other service providers that help us operate our store;
• payment processors, fraud-prevention providers, shipping carriers, marketing and analytics providers, social-media platforms, and advertising partners;
• consignors, suppliers, authorized representatives, or other people involved in a transaction; and
• public or commercially available sources when reasonably necessary for authentication, fraud prevention, legal compliance, or business records.
3. How We Use Personal Information
We may use personal information to:
• operate, maintain, personalize, and improve our website, physical store, and services;
• process orders, payments, shipments, deliveries, returns permitted by our policies, consignments, and consignor payouts;
• create and manage customer accounts, wish lists, loyalty features, and preferences;
• authenticate merchandise, evaluate provenance, prevent counterfeit sales, and maintain transaction records;
• communicate about orders, consignments, customer service, security, policy updates, and other transactions;
• send marketing communications where permitted and honor opt-out requests;
• measure site performance, understand customer interactions, personalize content, and evaluate advertising;
• detect, investigate, and prevent fraud, abuse, security incidents, chargebacks, and unlawful activity;
• enforce our agreements and protect the rights, safety, and property of Sui Generis, our customers, consignors, service providers, and others;
• comply with tax, accounting, consumer-protection, privacy, sanctions, customs, law-enforcement, and other legal obligations; and
• complete a merger, financing, reorganization, sale, or transfer of some or all of our business or assets.
4. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients for the purposes described above:
• Commerce and technology providers, including Shopify, website-hosting providers, customer-account tools, search providers, and store applications.
• Payment, fraud, and security providers that authorize transactions, reduce fraud, verify identity, or protect our systems.
• Shipping and fulfillment providers, including carriers, insurers, customs providers, and delivery services.
• Marketing, analytics, and advertising partners, including email and SMS providers, analytics services, social networks, and advertising platforms.
• Professional advisers, including attorneys, accountants, auditors, insurers, and consultants.
• Government authorities and other parties when required by law or reasonably necessary to protect rights, safety, property, or the integrity of a transaction.
• Business-transfer parties in connection with an actual or proposed merger, financing, reorganization, bankruptcy, sale, or transfer of business assets.
• Other parties at your direction or with your consent.
Service providers may process personal information only for contracted business purposes, subject to their agreements with us and applicable law. Some third-party services act as separate businesses and maintain their own privacy practices.
5. California Notice at Collection and Disclosures
In the preceding 12 months, we may have collected the categories described in Section 1 from the sources described in Section 2 and used or disclosed them for the business and commercial purposes described in Sections 3 and 4.
We may have disclosed identifiers, customer-record information, commercial information, internet or electronic activity, approximate geolocation, audio or visual information, consignor or supplier information, inferences, and limited sensitive personal information to service providers, contractors, payment and fraud providers, carriers, technology providers, professional advisers, government authorities, and business-transfer parties for permitted business purposes.
We do not sell personal information for money. However, our use of analytics, advertising, social-media, and Shopify services may constitute "selling" or "sharing" under California law when identifiers, internet activity, device information, commercial information, or related inferences are disclosed for cross-context behavioral advertising or similar purposes. California residents may opt out as described in Section 6.
We do not knowingly sell or share the personal information of consumers under 16 years of age. We do not sell or share sensitive personal information for cross-context behavioral advertising, and we use or disclose sensitive personal information only for permitted purposes such as processing transactions, security, fraud prevention, consignor payments, tax reporting, and legal compliance.
6. Your Privacy Choices
• Marketing communications: You may unsubscribe from marketing email using the link in the message. You may opt out of marketing text messages by following the instructions in the message. Transactional or service communications may continue where permitted.
• Cookies and advertising: You may use our cookie banner or browser settings to manage optional cookies. Blocking some technologies may affect site functionality.
• Opt out of sale, sharing, or targeted advertising: Visit our Data Sharing Opt-Out page (https://suigenerisconsignment.com/pages/data-sale-opt-out). Where required by law, we also process recognized Global Privacy Control signals as an opt-out request for the browser or device sending the signal.
• Do Not Track: Because there is no consistent industry standard for browser Do Not Track signals, we may not respond to those signals. This does not affect our processing of legally recognized opt-out preference signals such as Global Privacy Control where required.
7. California and Other U.S. Privacy Rights
Depending on where you live and subject to applicable legal thresholds, exceptions, and verification requirements, you may have the right to:
• know or access the categories and specific pieces of personal information we maintain about you;
• learn the categories of sources, purposes, and recipients associated with that information;
• delete personal information, subject to legal exceptions;
• correct inaccurate personal information;
• opt out of the sale or sharing of personal information or its use for targeted advertising;
• limit certain uses or disclosures of sensitive personal information where the law provides that right;
• receive a portable copy of certain personal information; and
• receive equal service and pricing without unlawful discrimination for exercising privacy rights.

To opt out of sale, sharing, or targeted advertising, use our Data Sharing Opt-Out page. We may ask for information reasonably necessary to verify your identity and authority. We will use verification information only to process the request.
An authorized agent may submit a request on your behalf where permitted by law. We may require proof of authorization and may separately verify your identity. If we deny an appealable request, residents of states that provide an appeal right may appeal by replying to our decision or contacting us using the information below with the subject line "Privacy Appeal."
8. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy. Retention periods depend on the nature of the information and our relationship with you, including the time needed to complete transactions and consignments, maintain accounting and tax records, prevent fraud, resolve disputes and chargebacks, enforce agreements, protect merchandise and customers, honor suppression preferences, and comply with legal obligations. We delete or de-identify information when it is no longer reasonably necessary, unless continued retention is permitted or required by law.
9. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No system, transmission, or storage method is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly if you suspect unauthorized account activity.
10. Children’s Privacy
Our website and services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13. If you believe a child has provided personal information to us, contact us so that we can review and, where appropriate, delete it.
11. Third-Party Services and International Processing
Our store is hosted by Shopify, and we use third-party applications and providers to operate our business. Personal information may be processed in the United States and other jurisdictions where Shopify or our providers operate. Those jurisdictions may have different data-protection laws. When required, we rely on appropriate legal mechanisms for transfers.
Links to third-party sites or services are provided for convenience. Their privacy practices are governed by their own policies, not this Policy.
12. Changes to This Policy
We may update this Privacy Policy to reflect changes in our practices, technology, services, or legal obligations. The Effective Date above identifies the current version. We will provide additional notice of material changes when required by law.
