PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING THE WEBSITE, CREATING AN ACCOUNT, SUBMITTING CONTENT, OR PLACING AN ORDER, YOU AGREE TO THESE TERMS OF SERVICE.
1. Scope and Acceptance
These Terms of Service ("Terms") govern your access to and use of suigenerisconsignment.com and related Sui Generis pages, services, purchases, communications, and transactions operated by SUI GENERIS INC, doing business as Sui Generis Designer Consignment ("Sui Generis," "we," "us," or "our"). By using the website or purchasing from us, you agree to these Terms and to the policies expressly incorporated by reference, including our Privacy Policy, Shipping & Delivery Policy, Refund / Final Sale Policy, and, where applicable, the Sui Generis Intelligence Terms of Use & Content License. Optional Seel Worry-Free Purchase® and Worry-Free Delivery® services are separate third-party products governed by the Seel terms shown at checkout and in Seel's confirmation.
If you do not agree, do not use the website or place an order. You must be at least 18 years old, or the age of legal majority where you live, to make a purchase.
2. Our Business; Consigned, Pre-Owned, and One-of-One Merchandise
Sui Generis is an independent designer resale and consignment retailer based in San Francisco, California. Merchandise may be pre-owned, vintage, archival, sample, deadstock, unworn but previously owned, or otherwise secondhand, and may be offered by Sui Generis on behalf of third-party consignors. Your retail transaction is with Sui Generis; a customer does not acquire direct contractual rights against a consignor merely because an item was consigned to us.
Many items are one-of-one and may be available simultaneously in our physical store and through other authorized Sui Generis sales channels. An automated order confirmation acknowledges receipt of an order; it does not guarantee availability or final acceptance. If an item sells elsewhere before inventory synchronizes, or is otherwise unavailable, we may cancel the affected order and refund amounts we captured for that item.
3. Independent Reseller; No Brand Affiliation or Authorization
Sui Generis is an independent reseller and consignment retailer. Unless expressly stated for a particular relationship, Sui Generis is not an authorized dealer, authorized reseller, franchisee, affiliate, agent, sponsor, partner, licensee, or representative of any designer, fashion house, brand, manufacturer, or trademark owner whose products appear on our website.
Designer names, brand names, logos, model names, collection names, and other trademarks are used for identification, description, commentary, research, comparison, and resale of genuine goods. Those marks and brand-owned materials remain the property of their respective owners. Their appearance on our website does not imply sponsorship, approval, certification, authorization, or endorsement of Sui Generis. Original brands do not participate in, supervise, or guarantee Sui Generis authentication unless we expressly state otherwise for a specific service or item.
4. Authenticity; Sui Generis Authenticity Remedy
Sui Generis stands behind its representation that merchandise it sells is authentic. Our authentication is an independent reseller assessment based on available product characteristics, construction, labels, identifiers, provenance information when available, reference materials, and our experience in designer resale. It is not an authentication, certificate, warranty, or approval issued by the original designer or manufacturer.
If, after reviewing a good-faith authenticity concern, Sui Generis determines that an item sold by us was not authentic, Sui Generis may rescind the sale and refund the original purchaser the purchase price and applicable sales tax actually paid to Sui Generis for that item, upon return of the same item in materially the same condition in which it was sold. Where appropriate and required by law, the remedy may also include original shipping charges. The purchaser must contact us promptly after discovering the concern and reasonably cooperate with our review, including providing photographs, identifiers, documents, and returning the item when requested.
This contractual authenticity remedy is separate from ordinary returns and does not create a general return right. It does not limit any remedy that applicable law does not permit us to waive. Because authentication characteristics can vary by era, market, category, production run, repair history, and product type, no single serial number, label, tag, card, receipt, package, chip, date code, stamp, or other isolated feature should be treated as conclusive by itself.
5. Pre-Owned Condition; Restoration, Repairs, and Product Descriptions
Unless expressly identified otherwise, merchandise should be assumed to be pre-owned. Vintage and pre-owned goods may show ordinary evidence of age, handling, storage, wear, prior cleaning, repairs, alterations, restoration, recoloring, re-dyeing, replacement components, patina, creasing, fading, pilling, pulling, oxidation, hardware wear, interior wear, surface marks, odor, or other characteristics consistent with prior ownership and age.
We use commercially reasonable care to identify material condition issues that we observe, but condition assessments involve judgment and descriptions are not intended to catalog every minute, cosmetic, or immaterial sign of prior use. Identification of a particular flaw does not mean that no other minor evidence of age or wear exists. Buyers must review the complete listing, photographs, stated condition, measurements, and included accessories before purchase.
Boxes, dust bags, authenticity cards, receipts, hangtags, extra straps, replacement parts, keys, clochettes, booklets, cases, and other accessories are included only when the listing expressly states they are included. Packaging or accessories may be from a different date, store, region, or production period unless expressly represented otherwise.
Measurements are approximate and may vary by measuring method. Designer sizing varies materially by brand, era, cut, and country. A marked size does not guarantee fit. Photographs are intended to depict the actual item unless expressly identified as reference imagery, but lighting, camera processing, display calibration, device settings, and material reflectivity can affect perceived color, texture, and scale.
6. Category-Specific Vintage and Pre-Owned Disclosures
Certain product categories have age-related characteristics that may not be apparent from appearance alone. Unless an individual listing expressly states otherwise:
Watches: water resistance is not guaranteed; exact timekeeping, power reserve, battery life, service history, pressure testing, and the originality of internal service components are not guaranteed. Vintage and pre-owned watches may require maintenance or service after purchase.
Jewelry: weights, dimensions, carat estimates, stone measurements, metal descriptions, and similar specifications may be approximate unless supported by an expressly identified laboratory report or assay. Buyers with metal sensitivities or allergies should rely only on expressly stated material information and should obtain independent advice when needed.
Shoes, sneakers, handbags, and coated or synthetic materials: adhesives, foam, rubber, soles, laminates, coatings, patent finishes, elastics, plastics, and synthetic materials can deteriorate with age even when an item appears lightly worn or unworn. Age-related deterioration after purchase is not by itself evidence that an item was misdescribed when its age and condition were accurately presented.
Eyewear: prescription lenses, if present, are not represented as suitable for the purchaser and should be evaluated or replaced by a qualified optical professional. Fit is not guaranteed.
Fragrance, beauty, or sealed vintage consumables, if offered: age, storage history, remaining shelf life, and formulation stability cannot be guaranteed unless expressly stated.
7. Safety, Recalls, Restricted Goods, and Product Warnings
We may refuse, remove, quarantine, cancel, or decline to ship any item that we reasonably believe is recalled, unsafe, counterfeit, stolen, illegally imported or exported, subject to sanctions, prohibited by platform or carrier rules, or otherwise restricted by law. We may also cancel an order if a legal, safety, customs, wildlife, sanctions, or carrier restriction is discovered after purchase.
Where a product-specific safety or California Proposition 65 warning is legally required or supplied to us for a covered product, the warning may be displayed on the product page, packaging, checkout path, or accompanying documentation. Customers are responsible for reviewing product-specific warnings before purchase. Nothing in these Terms is intended to replace a warning that applicable law requires to be displayed in a particular manner.
8. Sui Generis Photography, Descriptions, Editorial Copy, and Data
Unless otherwise credited, Sui Generis owns or controls the rights in its original product photography, original written descriptions, measurements and research compilations to the extent protectable, editorial copy, graphics, guides, page layouts, selection and arrangement of content, and other original website materials. These materials may be protected by copyright, trademark, contract, unfair-competition, database, and other applicable laws.
You may not copy, reproduce, republish, scrape, download in bulk, modify, distribute, license, sell, frame, mirror, remove attribution from, or use Sui Generis product photography or written listing content to advertise, authenticate, promote, or sell another item without our prior written permission. Product titles, names, and short phrases are protected only to the extent applicable law permits; however, automated extraction or reuse of our listing data, compilation, photography, descriptions, measurements, and site content is prohibited by these Terms.
Without prior written authorization, you may not use Sui Generis content or data to create or train a competing commercial database, image library, price guide, authentication product, machine-learning model, generative-artificial-intelligence dataset, retrieval corpus, automated resale listing system, or other commercial service; nor may you use bots or automated tools to monitor, copy, index, or extract inventory, prices, images, or descriptions at scale.
9. Orders; Acceptance, Availability, and Cancellation
We reserve the right to accept, reject, limit, hold, verify, or cancel an order for any lawful reason, including one-of-one item unavailability, simultaneous in-store sale, inventory discrepancy, pricing or description error, payment authorization issue, suspected fraud, identity-verification concern, sanctions or export restriction, carrier limitation, duplicate order, resale-abuse concern, or other operational or compliance issue.
If we cancel an order after capturing payment, we will return the amount captured for the canceled item or order using the original payment method, subject to payment-processor timing. Customer-requested cancellations are not guaranteed. Because unique items may be removed from other sales channels when an order is accepted, an order may become final immediately upon acceptance. An order that has entered fulfillment or carrier custody cannot be canceled merely because the buyer changed their mind.
10. Prices, Payment, Identity Verification, Taxes, and Errors
Prices are shown in the currency displayed at checkout and may change without notice before an order is accepted. Applicable sales tax, shipping, duties, customs charges, and other amounts will be added where required. You agree to provide accurate billing, contact, and payment information and authorize Sui Generis and its payment processors to charge the amounts shown at checkout.
For fraud prevention and legal compliance, we may request or use reasonable identity, billing, address, payment, device, or transaction verification before fulfillment. We may decline shipment to an address that materially differs from verified payment information or that presents elevated fraud risk. Failure to complete a requested verification may result in cancellation and refund.
If a material pricing, inventory, tax, or listing error is discovered before shipment, we may correct the error, contact you for instructions when appropriate, or cancel the affected order and issue an appropriate refund rather than fulfill an order based on an obvious or material error.
11. ALL SALES FINAL - No Returns, Exchanges, Refunds, or Store Credit
ALL SALES ARE FINAL. EXCEPT AS REQUIRED BY APPLICABLE LAW, UNDER THE EXPRESS AUTHENTICITY / MATERIAL MISDESCRIPTION REMEDIES IN THESE TERMS, OR THROUGH SEPARATE OPTIONAL SEEL WORRY-FREE PURCHASE® COVERAGE PURCHASED FOR A SPECIFIC ELIGIBLE ITEM, SUI GENERIS DOES NOT ACCEPT RETURNS OR EXCHANGES AND DOES NOT ISSUE REFUNDS OR STORE CREDIT FOR CHANGE OF MIND, FIT, SIZE, COLOR PREFERENCE, DUPLICATE PURCHASE, BUYER REMORSE, CONDITION CONSISTENT WITH THE LISTING, OR CARRIER DELAY.
By completing a purchase, you acknowledge that you have reviewed the item photographs, description, measurements, condition, included accessories, final-sale notice, and applicable shipping terms. Please contact us with questions before purchasing.
The final-sale policy does not eliminate rights that cannot legally be waived. Contact us promptly if Sui Generis ships the wrong item, fails to ship an accepted order, or the item received is materially different from an express factual representation in the listing. A material issue does not include ordinary wear or age characteristics consistent with the listing, a fit or sizing preference, or minor differences in perceived color caused by display or lighting conditions.
12. Shipping Time; Carrier Selection; Tracking
Any processing or shipping time we state is an estimate or shipment commitment, not a guaranteed delivery date unless we expressly state otherwise. We will use a commercially reasonable carrier and service level based on the order, destination, value, dimensions, and available services. Carrier transit estimates are controlled by the carrier and can change after shipment.
If we cannot ship within a time we expressly promised, or within the period required by applicable law when no shipment time was stated, we will provide any delay notice, cancellation option, or refund required by law. "Shipment" occurs when the merchandise is physically tendered to and accepted by the carrier.
13. Risk of Loss After Carrier Acceptance
Unless Sui Generis expressly agrees in writing to a destination-delivery obligation, orders are intended to be shipment contracts. To the fullest extent permitted by applicable law, risk of loss or damage passes to the purchaser when Sui Generis properly tenders the package to the selected shipping carrier and the carrier accepts custody, as evidenced by an origin, acceptance, pickup, or comparable tracking scan.
After carrier acceptance and tracking begins, the purchaser is responsible for monitoring tracking, following carrier notices, arranging receipt, and promptly contacting the carrier regarding delay, loss, theft, misdelivery, or transit damage. To the fullest extent permitted by law, Sui Generis is not responsible for carrier acts or omissions, transit delays, missed delivery attempts, package theft after delivery, misdelivery, or loss or damage occurring while the shipment is in carrier custody, except to the extent caused by Sui Generis or otherwise non-waivable by law.
If the carrier permits the recipient to file a claim, the purchaser is responsible for timely filing and pursuing the claim and preserving the package, contents, photographs, and other evidence. If the purchaser added Worry-Free Delivery® at checkout and Seel confirmed coverage for the shipment, any request under that separate protection must be filed directly by the purchaser through the Seel Resolution Center at resolve.seel.com. Seel independently administers and decides covered requests under its terms; Sui Generis cannot file the Seel claim on the purchaser's behalf or guarantee approval or payment. If a carrier requires the shipper of record to open the claim, the purchaser must notify Sui Generis promptly and within any carrier deadline, preserve all evidence, and reasonably cooperate. Sui Generis may submit the carrier claim where required, but submission does not guarantee reimbursement or acceptance by the carrier.
14. Delivery Address, Signature, Secure Receipt, and Delivery Confirmation
You are responsible for providing a complete, accurate, secure, and deliverable address at checkout. Address changes after order acceptance may be refused for fraud-prevention or carrier-security reasons. We are not responsible for loss caused by an incorrect, incomplete, obsolete, or insecure address supplied by the purchaser, except as otherwise required by law.
We may require signature confirmation, adult signature, identity verification, pickup, or other delivery controls. A carrier delivery scan, signature, pickup record, photographic proof of delivery, GPS record, or comparable carrier record may be used as evidence of delivery. You are responsible for promptly retrieving packages delivered to lockers, access points, reception desks, mailrooms, doormen, neighbors, or other locations or persons authorized by you or reasonably designated for the address.
15. Refused, Undeliverable, Abandoned, or Returned-to-Sender Shipments
If a shipment is refused, unclaimed, not collected, returned because duties or charges were not paid, sent to an inaccurate address supplied by the purchaser, or otherwise returned to Sui Generis for a reason not caused by Sui Generis, the original sale remains final to the fullest extent permitted by law. The purchaser is responsible for carrier return fees, customs charges, brokerage, storage, address-correction charges, and reasonable re-shipping costs caused by the failed delivery.
Re-shipment is subject to verification and payment of applicable additional charges. If a returned shipment cannot legally or practically be re-shipped, Sui Generis may determine the appropriate disposition consistent with applicable law and the circumstances. We do not promise a refund for buyer-caused nondelivery, refusal, abandonment, or failure to pay import charges.
16. International Orders; Customs, Sanctions, Exotic Materials, and Import Restrictions
International purchasers are responsible for determining before purchase whether merchandise can lawfully be imported into the destination country and for all import duties, customs charges, brokerage fees, taxes, inspections, permits, and other destination-country or carrier charges unless checkout expressly states otherwise. We do not control customs processing times.
Some vintage fashion goods may contain exotic leather, fur, shell, coral, feathers, mother-of-pearl, reptile, wildlife-derived material, precious materials, or other components subject to CITES, wildlife, customs, sanctions, export, import, or carrier restrictions. International shipping may be unavailable even where domestic sale is lawful. We may cancel or decline any shipment when documentation, destination law, carrier rules, sanctions, or wildlife restrictions make shipment unlawful, impracticable, or unreasonably risky.
Refusal to pay import charges, failure to obtain a required permit, customs seizure caused by a destination restriction, or abandonment of a shipment does not automatically create a right to refund where the order and shipment were otherwise lawful and properly handled, subject to non-waivable consumer rights.
17. Payment Disputes and Chargebacks
If you believe there is a genuine billing, authenticity, delivery, or fulfillment error, please contact Sui Generis promptly so we have an opportunity to investigate. Nothing in these Terms prevents a consumer from exercising lawful payment-card dispute rights. Knowingly filing a false chargeback, falsely claiming non-receipt after documented delivery, returning a different item, or materially misrepresenting a transaction may constitute fraud. We may provide relevant order, authentication, tracking, delivery, communication, and account records to payment processors, financial institutions, insurers, law-enforcement authorities, or other appropriate parties.
18. Website License and Prohibited Uses
Subject to these Terms, Sui Generis grants you a limited, revocable, non-exclusive, non-transferable license to access the website for personal shopping and informational use. No ownership rights are transferred to you.
You may not use the website to violate law; infringe intellectual-property, publicity, or privacy rights; interfere with security; introduce malicious code; impersonate another person; submit fraudulent orders; scrape or harvest content or personal data; reverse engineer non-public systems; circumvent access controls or rate limits; conduct automated inventory, price, image, measurement, or description extraction; create a substantially similar competing content service from our materials; or use the website in a manner that could harm Sui Generis, customers, consignors, service providers, or third parties.
19. Customer Accounts and Electronic Communications
You are responsible for safeguarding account credentials and for activity occurring through your account to the extent permitted by law. Notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts associated with fraud, abuse, repeated payment disputes, scraping, security concerns, or violations of these Terms.
You agree that transactional notices, receipts, policy notices, security communications, and other legally permitted communications may be provided electronically. Marketing communications remain subject to applicable consent and opt-out requirements.
20. Reviews, Photographs, Messages, and Other Submitted Content
If you voluntarily submit a review, photograph, comment, testimonial, item information, provenance document, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and non-infringing. You grant Sui Generis a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt for formatting, display, archive, and distribute that submitted content for evaluating, authenticating, cataloging, marketing, selling, supporting, or documenting merchandise and our business, subject to applicable privacy law and any narrower written agreement that applies to a particular consignment.
We may remove or decline submitted content that is unlawful, abusive, deceptive, irrelevant, unsafe, or infringes third-party rights. Submission of content does not transfer ownership of third-party trademarks or copyrighted works that you do not own.
21. Third-Party Services and Links
The website may use or link to third-party services, including Shopify, payment processors, fraud-prevention providers, shipping carriers, Seel post-purchase protection services, social networks, analytics providers, maps, and external reference sources. Those third parties operate under their own terms and privacy practices. Sui Generis does not control and is not responsible for third-party websites or services merely because we link to or use them.
22. Sui Generis Intelligence
Sui Generis Intelligence, including designer authentication guides, original research graphics, downloadable infographics, and related research tools, is additionally governed by the separate Sui Generis Intelligence Terms of Use & Content License. If there is a conflict concerning use of Intelligence content, the Intelligence-specific terms control for that content.
23. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS GENERAL INFORMATION ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
EXCEPT FOR EXPRESS FACTUAL REPRESENTATIONS WE MAKE ABOUT A SPECIFIC ITEM, THE EXPRESS AUTHENTICITY REMEDY ABOVE, AND RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED, PRE-OWNED GOODS ARE SOLD IN THEIR DISCLOSED CONDITION WITH THE CHARACTERISTICS OF PRIOR OWNERSHIP. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Nothing in these Terms excludes a warranty, duty, liability, or remedy that applicable law does not permit us to exclude or limit.
24. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SUI GENERIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE WEBSITE OR A TRANSACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, SUI GENERIS'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO SUI GENERIS FOR THE ITEM GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW, INCLUDING LIABILITY THAT CANNOT BE LIMITED FOR FRAUD, WILLFUL MISCONDUCT, PERSONAL INJURY CAUSED BY LEGALLY NON-WAIVABLE CONDUCT, OR OTHER NON-WAIVABLE RIGHTS.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold Sui Generis and its officers, directors, employees, and agents harmless from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, your infringement of another person's rights, or fraud or misconduct attributable to you. This section does not require a consumer to indemnify Sui Generis for Sui Generis's own unlawful conduct.
26. Force Majeure
Sui Generis is not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, natural disaster, fire, power or network failure, carrier interruption, labor dispute, government action, war, civil disturbance, public-health emergency, cyberattack, customs hold, sanctions change, or interruption affecting vendors or infrastructure, provided this section does not waive obligations that applicable law requires us to perform.
27. Privacy
Our collection and use of personal information is governed by our Privacy Policy and applicable privacy law. The Privacy Policy is separate from these Terms and should be reviewed before using the website or submitting personal information.
28. Governing Law and Venue
These Terms and transactions with Sui Generis are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires another result. Subject to any non-waivable consumer right to bring a claim elsewhere, the state and federal courts located in San Francisco County, California will have jurisdiction over disputes arising from these Terms or a purchase from Sui Generis, and you consent to personal jurisdiction in those courts.
29. Severability; Waiver; Assignment
If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure by Sui Generis to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a merger, sale, reorganization, financing, or transfer of all or part of our business, subject to applicable law.
30. Changes to These Terms
We may revise these Terms from time to time. The effective date above identifies the current version. Changes apply prospectively from the date posted unless applicable law requires another process. Material changes will be communicated when required by law. The Terms in effect when an order is accepted generally govern that transaction, except where a later change is required by law or expressly agreed to.
31. Entire Agreement; Policy Priority
These Terms, together with policies and transaction-specific terms expressly incorporated by reference, constitute the agreement between you and Sui Generis regarding use of the website and purchases from us, except for a separate written agreement signed by Sui Generis that expressly overrides these Terms. A product-specific disclosure controls over a more general statement where the two directly conflict. The Intelligence Terms control use of Sui Generis Intelligence content.
